SMS Terms and Conditions

These SMS Terms of Service govern the text-messaging program offered by Tim Proctor Insurance Agency, also doing business as Covered California Certified Agent (“we,” “us,” or “our”).
By providing your mobile telephone number and affirmatively opting in to receive text messages, you agree to these SMS Terms of Service.
1. SMS Program Description
Our SMS program is used to communicate with individuals who have requested information or assistance from us.
Messages may relate to:

Your wireless carrier’s standard messaging, data, and other charges may apply to messages that you send or receive. Contact your wireless carrier for information regarding your mobile plan.
5. Opting Out
You may cancel SMS messages at any time by replying: STOP
You may also use other commonly recognized opt-out commands, including:
CANCEL, END, QUIT, REVOKE, OPT OUT, or UNSUBSCRIBE
After submitting an opt-out request, you may receive one final message confirming that you have been unsubscribed. You will no longer receive SMS messages from that messaging program unless you subsequently provide consent again.
Opting out of SMS messages does not prevent us from communicating with you through other methods when permitted, such as telephone calls or email.

7. Supported Carriers
Our SMS program may be available through participating United States wireless carriers. Wireless carriers are not responsible for the content of messages sent through our program. Carriers are not liable for delayed or undelivered messages.
Message delivery is subject to effective transmission by your wireless carrier and is outside our complete control.
8. Eligibility
To participate in our SMS program, you must:

Use a participating wireless carrier

By enrolling, you represent that you satisfy these requirements.
9. Mobile Number Changes
You agree to notify us if you stop using or no longer control the mobile number you provided. Before changing, transferring, or disconnecting your mobile number, you should reply STOP to unsubscribe from our SMS program.
You are responsible for ensuring that a subsequent owner or user of the telephone number does not receive messages intended for you.
10. Privacy and SMS Data Sharing

Mobile information, telephone numbers, SMS opt-in data, and text-messaging consent will not be sold, rented, shared, transferred, or disclosed to third parties or affiliates for marketing or promotional purposes.

11. Insurance-Related Communications
Text messages are provided for informational and customer-service purposes. A text message does not create, bind, modify, renew, or cancel insurance coverage.
Insurance coverage is subject to the terms, conditions, eligibility requirements, enrollment rules, effective dates, and approval processes of the applicable insurance carrier, marketplace, or government program.
Do not send Social Security numbers, payment-card information, medical records, account passwords, or other highly sensitive information through SMS unless we specifically provide a secure method for doing so.
12. Emergency Communications
Our SMS service is not an emergency service and should not be used for urgent medical, safety, or emergency communications.
For an emergency, call 911 or contact the appropriate emergency-service provider.
13. Availability and Delivery
We do not guarantee that every message will be delivered, received, or delivered within a particular period.
SMS service may be affected by:

Carrier filtering or restrictions

Device compatibility

Internet or telecommunications outages

Incorrect or disconnected telephone numbers

Circumstances outside our reasonable control
We are not responsible for delayed, blocked, misdirected, or undelivered messages caused by these conditions.
14. Changes to the SMS Program
We may modify, suspend, or discontinue all or part of our SMS program at any time.
We may also change the telephone number or short code used to operate the program. Messages sent to an outdated number may not be received.
Material changes to these SMS Terms of Service will be posted on this webpage with an updated revision date.
15. Changes to These Terms
We may revise these SMS Terms of Service periodically to reflect changes in our services, business practices, technology, or applicable requirements.
Your continued participation in the SMS program after updated terms become effective constitutes acceptance of the revised terms, to the extent permitted by law.
16. Termination
We may suspend or terminate your participation in the SMS program if:

17. Limitation of Liability
To the fullest extent permitted by applicable law, Tim Proctor Insurance Agency will not be liable for losses arising from delayed, failed, blocked, intercepted, misdirected, or undelivered SMS messages or from your reliance on information transmitted through SMS.
Nothing in these terms limits any rights or remedies that cannot lawfully be limited.
18. Governing Law
These SMS Terms of Service are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable federal law controls.
